摘要
"小产权房"的产生有其深刻的制度和经济背景,是房地产开发和集体建设用地使用权人多方利益主体博弈的产物,也折射出我国农村宅基地使用权流转制度存在的缺陷。"小产权房"有其存在的合理性,但我国现阶段缺少"小产权房"合法化的相关规定,使其面临着生存的困境。"小产权房"的出路是合法化:应以"合法化"为目标,恰当处理好"小产权房"问题,以保护出让者、购房者的合法权益。
The paper focuses on 'the housing of small property right',which reflected the defects involved in the system on transferring rights of rural residence base utilization.The paper goes on to argue that 'the housing of small property right' has its own rationality,but it must be legalization;we should appropriately handle the problem so as to protect the legitimate interests of those who sell or buy a house.
