文章从律师的价值与性质问题上进行论述,通过分析本国及国外的法律条文,以及律师在现实司法活动中的行为,阐述当代律师的职能与社会地位;最后从具体刑事审判中,律师与法官、检察机关三者的职责与关系,各自所承担的义务与享有的权利,说明律师在我国当代具体刑事审判中所扮演角色。

This article elaborates the function of modern lawyers and their social position by analyzing the provisions provided in our law and those in other countries and the lawyers＇ performance in judicial activities.Finally,it attempts to throw light on the role the lawyers play in criminal trials in our country through analyzing the relationship between the lawyer,the judge and the prosecutor,and their duties as well as their rights and obligations.
