论罗马法中的刑事责任制度

On the System of Criminal Liability in Roman Law

The system of criminal liability in Roman Law has three characteristics： civil liability mixed with criminal liability and issues of criminal liability were handled in the way of civil liability;equal liability existed together with unequal liability;criminal responsibility-classifying took the principle of tort liability.The conformation of the system of criminal liability in Roman Law was related to Roman＇s developed slave-owning economy,the relatively equal political status between the nobility and common people,and flourishing law studies.This system has a far-reaching influence on the aftertime so that we should pay great attention to the study of it.
