法律移植在我国并没有取得很好的效果,最主要的原因是我国对国外法律制度的移植缺少对于法律精神层面的认同,也就是说法律规定与现实生活相脱节,而导致法律难以发挥其在社会中应有的作用。针对目前我国的现实情况,法律移植的主要任务就是为人民创造一个良好的实行新的法律的环境,一种有效的资源——法律意识赖以生存的社会土壤。

The legal transplant in China did not achieve good results,mainly because our legal system lacked of recognition for the spirit level of the law on foreign trans-plants, that was the law was out of touch with the realities,which led to the law was difficult to play its proper role in society. Aimed at the reality of China,the main task of legal transplants is to create a good environment to implement the new law for the people,a useful resource-the social soil of legal awareness.
