论渔业行业协会法律问题

On legal issues relating to industrial association of fisheries

渔业行业协会是由渔业部门作为业务主管单位的行业协会,除具有同业性、自愿性、非营利性、民间性、自治性等行业协会共有的特征外,还具有规模小、经济实力弱、公民文化意识弱等特征。阐述渔业行业协会的概念、特征、功能和分类,分析所面临的法律政策问题,指出应制定专门的渔业行业协会条例,行政审批、登记的设定和实施应遵守《行政许可法》,尊重协会的自治权,依法规定政府对渔业行业协会的财政扶持政策,建立信息披露制度,依据行业影响力对其实施动态管理。

The industrial associations of fisheries are those associations administered by administrative departments of fisheries.In addition to the major common characteristics（one-sector,voluntariness,non-profit,non-government, self-government） shared by all industrial associations,they also carry exclusive ones,e.g.small number of members,limited finance resource and weak consciousness of civil rights.Hereby,the concept,characteristics,functions and classification of fishery associations were expounded;some problems of laws and policy relating to fishery association were analyzed.It is concluded that a specific regulation of industrial associations of fisheries shall be made;that related administrative approvals and registration shall be created and carried out in accordance with the Law of Administrative Approval;that rights of self-government of association shall be respected;that special policy of financial support to associations shall be declared in the related laws;that regime of information publicity shall be established;and finally that a dynamic model of administration may be created on the basis of associations influence on fisheries.
