社会保障民营主体协同治理及其公法规制

摘要 社会保障民营化虽然能够暂时缓解社会转型时期所引起的各种社会问题,但民营主体参与社会保障管理和服务却容易削弱行政法对公共主体决策应具备的公正、合理、公开等基本要求,从而使社会保障本身的公共性发生异化。只有明确民营主体的公法地位,确立公法背景下社会保障各主体之间的协同治理关系,并通过适度把握治理范围、调适协同治理关系、补充完善治理机制等方式,才能确保社会保障管理和服务公益属性的实现。 The privatization of social security system could temporarily solve many problems of government failure,and it also weakens the administration law requirements of fair,reasonable and public,which may change the social security system.To specific the status of private principle and the relationship of the principles of social security system,will ensure the public prosperity of service and management of social security system.
