包摄错误是指行为人对于构成要件要素理解错误,误认为自己所为行为不能为刑法所包摄。从法律效果上来讲,包摄错误不构成事实错误,但是有可能构成禁止错误。反面包摄错误作为幻觉犯的形态之一,不构成犯罪。
Subsumption mistake refers to the misunderstanding of the actor to the constituents regulated in the criminal law.The actor thought own actions are not included in the criminal law.From the legal effect,subsumption can＇t make fact mistake but forbidden error.Inverse subsumption is one form of imaginary offence and does not constitute a crime.
