摘要
《物权法》中虽然对房屋所有权的保护有相关强制性规定,但该规定在具体保护被拆迁人利益时,存在诸多问题,如:没有区分公益性拆迁和商业性拆迁;未明确规定政府在商业性拆迁中的地位。因此,天价的房地产业违背了经济规律,也远离了民生,而幕后的鼓动者不仅仅是唯利是图的商人,还有别有用心的地方官员。我们应反思:一是在市场经济中政府的职能究竟是什么;二是目前的官员考核制度存在哪些不足。对用人制度进行深刻的反思,进一步完善房屋拆迁中的相关制度,保护权益人的合法权益。
Jus Rerem has related contents about the protection for real property right of householders,but these contents have many disadvantages,when they are put into effects,for example,it doesn't distinguish the public removing between commercial removing;and doesn't regulate the government's position for commercial removing,as a result,the higher price for real property,not only breaches the priciples of economy,but also goes against the public interests,while the backgronud agitaters are both real dealers and district officials.Facing the fact,we should reflect two questions:one is the position of government in market economy,the other is disadvantages of present examing system for officials.What's more,we should manipulate more effective regulations,and make full use of the present related regulations to protect the right of householders.
