侵害人身自由权的精神损害赔偿分析

人身自由权是人身权中的一项重要权利。现行立法在侵害人身自由权的精神损害赔偿方面的规定存在着诸多不足,对如何做到真正意义上的保护公民的人身自由权提出了四点建议:在法律中明确规定侵害人身自由权的精神损害赔偿;制定统一的赔偿标准;确定赔偿数额;完善刑事附带民事诉讼对精神损害赔偿的规定。

Right of personal freedom is very important one of personal rights.The existing legislation is not at all sufficient in the regulation of moral damage compensation for violations of personal freedom right.This article puts forward four pieces of suggestion as how to really protect right of personal liberty.Firstly,moral damage compensation for violations of personal freedom right should be clearly demanded in law.Secondly,we should draw up unified compensation standards.Thirdly,we should formulate exact compensation amount.Lastly,we should improve the regulations of compensation for moral damage in criminal with civil proceedings.
