小产权房利益博弈及出路——从“正名”来分析 被引量:2

摘要 楼市的高房价催生出大量的小产权房,并成为社会关注的焦点。几年前"画家村"案件将小产权房买卖合同的效力推到了风头浪尖,而最近热议的物业税和对小产权"正名"的呼声又让小产权房问题升温。小产权房实际上是因规则欠缺而导致的各利益主体之间的博弈。要解决此问题应循序渐进地改革现有的制度。就目前而言,应平衡各主体之间的利益冲突,如有限度地为小产权房"正名"、增设物业税等,但改革现有的土地制度和城乡二元政策势必在行。 The small property right houses emerging in the context of the high-price housing, has become a great social concern. While the case of "artist village" became the focus of debate on the validity of contracts, the recent debate of the property tax and the voice of name arise extensive concern in the society. Actually it is a game short of rule between the different interest bodies. To solve this problem, it is supposed to take revolutionary measures step by step. Recently, it needs taking steps to balance the interest of the bodies, such as recognizing the small property house's legitimacy, and levying the property tax. In the long run, it is imperative to reform the land system and revise the urban-rural dual policy.
