论我国低碳经济发展的法律保障

On Legal Protection for the Development of Low-carbon Economy in China

低碳经济的发展目标是既要实现低能耗、低排放、低污染,抑制全球气候变暖,又要实现经济的可持续发展。因而,研究低碳经济发展的法律保障具有十分重要的意义。我国低碳经济发展的法律有国际公约与协定、国内法律规范两个部分。国际公约与协定主要是《联合国气候变化框架公约》与《〈联合国气候变化框架公约〉京都议定书》;国内法律规范主要有《中华人民共和国节约能源法》、《中华人民共和国清洁生产促进法》、《中华人民共和国可再生能源法》、《中华人民共和国循环经济促进法》等及其他的法规与规章。无论是国际公约与协定还是国内法律规范,对我国低碳经济的发展都起着十分重要的保障作用,但也存在明显的不足,因而需要完善。

Low-carbon economic development goals is to achieve both low power consumption, low emissions, low pollution and curb global warming, and to achieve sustainable economic development. Thus, the study of low-carbon economic development in the legal system is of great significance. And China＇s low-carbon economy is closely related to the law of international conventions and agreements, national laws and regulations in two parts. International conventions and agreements are the ＂United Nations Framework Convention on Climate Change,＂ and ＂＂ United Nations Framework Convention on Climate Change, ＂Kyoto Protocol＂; There are domestic laws and regulations, ＂The People＇s Republic of China Circular Economy Promotion Law,＂ ＂The People＇s Republic of China Energy Conservation Law,＂ ＂The People＇s Republic of China Renewable Energy Law,＂ ＂The People＇s Republic of China Cleaner Production Promotion Law＂, etc., and other laws and regulations . Both the international conventions and agreements and domestic laws and regulations, play an important role in protection of the development of China＇s low-carbon economy, But there are obvious shortcomings, and thus to be perfected.
