从白云山版“达菲”事件看我国药品专利强制许可制度

Consideration of medicine patents compulsory license system in China:from the "Tamiflu" case of Guangzhou Baiyunshan Pharmaceutical Company

药品专利强制许可制度对限制专利滥用及保护公共健康具有重要意义。文中从白云山制药厂为仿制生产"达菲"申请启动强制许可程序出发,在介绍与贸易有关的知识产权协定(TR IPS)框架下强制许可制度的基础上,分析白云山强制许可申请的正当性及批准该申请的必要性,提出以从属专利寻求药品专利强制许可出路的建议。

Medicine patents compulsory license system has great significance in restrictions on patent misuse and protecting public health.Based on the ＂Tamiflu＂ case of Guangzhou Baiyunshan Pharmaceutical Co.,Ltd.,the article has introduced the medicine patents compulsory license system under Agreement on Trade-Related Aspects of Intellectual Property Rights（TRIPS）,and analyzed the legitimacy and the necessity to approval of this application,then tabled a proposal to emphasize the dependent patent.
