城乡规划争议中的原告资格——日本法上的启示

Plaintiff Qualification in Urban and Rural Planning Disputes——Enlightenment of Japanese Law

城乡规划的实施往往给周边居民带来噪音、日照、辐射等生活环境上的巨大影响,作为规划许可的第三方,受到利益侵害的周边居民在一定条件下应具有通过行政诉讼撤销规划许可的原告资格。观照日本立法和判例上应对社会现实,发展原告资格的判断方法、赋予一定范围内周边居民针对建设项目规划行为提起争议法律地位的实践,我国城乡规划争议中原告资格的判断应重点解释"合法的"、"法律上的"之概念、并进一步区分特定主体的利益。

Since the carry out of urban and rural planning usually brings much effect to the living environment around,such as noise,sunshine,radiation,etc.,being as the third party of the planning licenses,the residents around whose interest is infringed should be authorized plaintiff qualification to revoke the licenses by administrative litigation in some condition.Basing on analyzing the development of plaintiff qualification judgment in Japanese Law and Cases,i.e.authorizing residents in a certain range to raise a litigation on construction project planning act,this paper points out that in China,when judging plaintiff qualification much emphasis should be put on the definition of ＇protected＇and ＇legal＇as well as the distinction of interest among specific subjects.
