被追诉人的权利不管是在刑事诉讼立法还是在司法实践中,一直都是关系中国法治建设进程的一个重要方面,它不仅象征着我国的民主和文明程度,也关系着我国的人权保障事业能否顺利进行,能否与世界接轨,获得国际认同。从我国的立法现状与司法实践不难发现,其中存在着很多与国际性文件和其他国家法律文件与实践相差甚远的地方。通过对比国际上公认的法律文件,从保障被追诉人的权利的必要性与紧迫性方面分析我国现行刑事诉讼法,得出我国进行立法与司法改革十分必要,并提出改革建议。

The right of the accused plays an very important role in both civil suit legislation and actual judicial practice,and it is always one of the most important aspects in the development of Chinese legal system building. It is not only a symbol of Chinese enlightened master and civilization, but a/so in relation of international acception. According to Chinese legislation and actual judicial practice, there are many differences between China and other countries. Under this kind of situation, accoding to the difference between Chinese criminal procedure law, it is necessary to face the reform of judicial affairs. The necessity and urgency about the the accused are discussed.
