Legislation of China’s Pre-school Education:Reflection and Progress

学前教育是基础教育的重要组成部分,对促进个体全面健康发展,巩固和提高九年义务教育质量与效益,全面提升国民整体素质具有重要的基础性、先导性的作用。公益性是学前教育的根本性质。将学前教育纳入公共服务体系,主导学前教育事业的健康、有序发展是现代政府的重要责任,其中,立法保障和促进学前教育事业发展既是现代政府职责的重要内容,也是破解当前我国学前教育发展诸多突出问题的关键所在与迫切需求。当前我国学前教育事业发展的主要问题有:学前教育行政管理力量严重不足,幼教领导与管理失去有效保障;学前教育经费严重匮乏,事业发展缺乏基本的经费保障;幼儿园的办园体制、投入体制发生了根本变化,急需在构建社会公共服务体系过程中构建学前教育新体系;教师身份不落实、待遇缺乏保障,队伍不稳定;各种社会力量办园的条件、权力和行为缺乏应有的规范与保障等。要从根源上解决这些问题,必须有上位的法律规范与保障,因此,专门法的缺失已严重制约我国学前教育事业的健康有序发展。目前,我国学前教育立法已具有较好的社会、经济与法律基础。我国学前教育立法的基本理念应包括:强化学前教育的公共性与公益性;凸显和增强政府发展学前教育事业的职责;以公平和均衡为基本立法价值取向,优先保障并向农村和弱势群体倾斜。立法重点应抓住影响学前教育事业发展的根本性、深层次的核心问题,特别是明确规定学前教育的性质地位、政府职责、管理体制、投入体制、办园体制、教师队伍建设及建立督导评估与问责制度等。

Pre-school education as an important part of elementary education plays a fundamental and leading role in advancing individual development in an overall and healthy way, in consolidating and promoting the quality and beneficial result of the 9 years’ compulsory education, and in elevating the quality of the whole people. The publicity is the primary nature of pre-school education. It is therefore the responsibility of a modern government to take pre-school education into the public service system and to guide it in a wholesome and ordered way. Accordingly, it is not only the area of the governmental duty to have legislation guarantee and furthering pre-school education cause; it is also the key to, and the urgent demand of, the numerous problems in the current development.
