摘要
不同制度对刑事司法权的时间规限是一个共同选择。这一规限主要是通过办案期间来完成的。办案期间本身具有授时与限时两种功能,同时还具有与制度结构的适应性、同其它诉讼制度的牵制性、在整个诉讼程序分布的非均衡性等特征。办案期间制度存在多元的立法表现形式,主要包括具体规定型与原则规定型。这表面上看是一种立法技术问题,而事实上却具有深刻原因。一定制度中的期间制度的立法模式必须与司法传统、诉讼架构、司法权分配格局等相契合。
Terms for prosecution and punishment are set in any criminal procedure.The terms in criminal procedure have two basic functions：authorization and limitation.Regulation of criminal case term is closely related to other regulations and deep-rooted in the whole criminal procedural system.The criminal procedural term may react on the procedure itself.Different procedural model make the importance of a certain procedural phase different,which is significant to the terms setting and makes the terms unbalanced in different phase.Forms of term in law are various,specific and general provisions made in accordance with various situations are the main model.At the first sight,this is mere a legal technique.In fact,it should be compatible with specific procedures
