论《中华人民共和国体育法》修改的宏观态势与应对方略

立法中的某些仓促、技术上的诸多欠缺,多元化的利益带来的冲突以及制度未有效确立而产生的混乱与无序强力催生了〈体育法〉修改工作的开展.现行〈体育法〉的＂专题法＂属性以及修改后的〈体育法〉所应调整的社会关系的＂不减反增＂共同促成了其＂专题法＂地位的进一步巩固,相应地也导致了大量体育社会关系被或可能被法律交叉调整.修改〈体育法〉的过程,很大程度上就是竞技体育领域＂法律规范新创＂的过程,＂人无我有＂与＂人有我特＂的＂法律规范新创＂方能彰显〈体育法〉修改本身的意义与价值.〈体育法〉＂法律后果＂与＂行为模式＂要素的补全与完善无疑将有助于很多问题得以解决,应有的威慑力与强制力也将得以发挥.

It intensely brought about the modification procedure of Sports Law that there were hasty legislation,technical deficiency,diverse interests’ conflict and chaos and disorder caused by lack of system establishment.Both the Special Law attribute of present Sports Law and social relations addition of Sports Law modification help to its status consolidation as the Special Law.Hence,the regulation of a lot of sports social relations may be overlapping.To a large extent,the process of Sports Law modification is also the process of new creation of legal norms in the competitive sports field.This new creation of legal norms demonstrates the significance and value of Sports Law modification.Undoubtedly,the completion and perfection of legal consequences and behavior elements for Sports Law can contribute to rigid constraint strengthening of looseness of former law.Moreover,it can help the deterrence and enforcement of Sports Law to work more effectively.
