完善中国特色现代大学制度的法治化途径

Approach to Improve Modern University Institutions with Chinese Characteristics by Rule of Law

法治视域下的现代大学制度,就是在政府宏观管理下的"自主办学",在多种力量作用下的"民主办学",在自我约束机制下的"依法办学"。完善中国特色现代大学制度,需要用自治的原则和法治的理念,审视大学现实制度环境和突出问题,理顺大学与政府社会的关系,落实大学办学自主权,强化大学法人地位,大力推进依法治校,实现从"大学管理"向"大学治理"的转变。

Modem university institutions in the context of rule of law are ＂independently running the universities＂ under the government＇s macro-administration, the ＂democratically running the universities＂ affected by a variety of power, and ＂running universities according to the law＂ under the mechanism of self-restraint. To improve modem university institutions with Chinese characteristics needs taking the following measures： to stick to the principle of autonomy and the concept of rule of law; to examine the practical institutional environment of universities and serious problems; to straighten out the relationship among the university, government and society ; to strengthen autonomy of running universities and the legal status of universities; to promote run- ning universities according to law vigorously; and accomplish the transformation from ＂university administration＂ to ＂university governance＂.
