基层行政管理权与社区自治权良性互动的路径研究——以苏州Z市为例

On the Path of the Interaction Between the Community Autonomic Right and the Grass-root Administrative Right—a Case Study of Z City in Suzhou

民主与法治是社会和谐的两大基石。社区自治作为民主主体及基本表现形式成为和谐社会构建的重点和难点。作为诱发性和强制性混合的社会模式转变,和谐社会的构建显然离不开政府的强力推动。如何整合政府与公众的双向力量,形成和谐社会构建的合力,成为关键问题。而要形成政府与公众的双向合力,就必须实现政府基层行政管理权与公众社区自治权的良性互动。本文以苏州Z市为例,对如何实现基层行政管理与社区自治权良性互动路径进行探索,即以基层政府与自治组织的职能界定为先导,配之以衔接机制创新和绩效评估机制创新。

Democracy and rule by law are two of the cornerstones of social harmony. Self-government of community, as the main and basic forms of democracy, become the focus and difficult point of building a harmonious society. Of course, as mixed evoked and mandatory social model changes,construction of a harmonious society can not be separated clearly from the strong push of Government. How to integrate two-way forces between the Government and the public forces to form a joint force to build a harmonious society becomes the key issue. To form a two-way joint force between the Government and the public, it is necessary to realize the benign interaction between the right of the primary government and the administrative autono-my of public communities. This article takes Suzhou Z City as an example to explore how to realize the benign interaction between the right of the grass-root governments and the administrative autonomy of public communities, that is, taking the classification of functions of the primary government and self-governing organizations as a guide,combined with a bridging mechanism innovation and performance evaluation mecha-nism innovation.
