本文以首例集成电路佈圖設計撤銷案为线索,对其中涉及的依職權啟动、舉證責任分配以及技术鉴定等问题进行研究,试圖为建立和完善相关这類案件的審查標準的確立提供参考。

This article will be probing into the first case involving cancellation of a layout-design of integrated circuit,looking into such issues as initiation of the cancellation examination proceedings, ex officio,distribution of burden of proof and technical appraisal in an attempt to provide information of reference for the purpose of establishing and improving the standards for the examination of cases of the nature.
