摘要
《劳动合同法》确立了我国劳动关系的发展方向,对促进劳动关系的和谐发挥着重要的作用。然而,它仍存在一些不尽完善之处,体现在单保护原则的不合理,规范用人单位裁员及劳动派遣行为的条文和适用无固定期限劳动合同的劳动者权利救济的条文不完备等。笔者从以上方面入手,对完善《劳动合同法》提出相应的建议,使它能更好地保障我国劳动关系的和谐。
Labor Contract Law established development direction of Chinese labor relations in the future,playing an important role in promoting harmonious labor relations.However,there still exist a few imperfections,reflected in unreasonable single-protection principle,the imperfect items about employer’s layoff,the labor dispatch and workers’relief right on non-fixed term labor,etc.The article,based on the above-mentioned imperfections,makes corresponding suggestions to improve the Labor Contract Law to better protect the labor relation harmony.
