摘要 2007年10月1日正式实施的《中华人民共和国物权法》就建筑区划内车位、车库的归属专门做出了规定,在民事基本法的层面上填补了我国住宅小区车位、车库归属与使用的法律空白,其积极的意义不容置疑,然而在解决实际问题中仍存在一定缺陷。建筑物区分所有权理论是解决小区停车位在法律上权利归属的基础,以此为切入点,在理论界已有研究的基础上,从车位、车库的归属现状、法律性质、类型、归属学说、我国立法等多方面入手,运用比较分析等方法予以探讨,以期进一步完善我国的相关法律法规。 The Property Law,which was carried out on 1st October,2007,prescribes the ownership of parking lots and garages.It fills the blank in legislation in view of the Civil Fundamental Law and has positive significance,while it still faces with the difficulties in solving practical problems.On the basis of the existed researches and using the method of comparison,this paper takes condominium ownership theory,which is a basic theory to decide the ownership of parking lots in residential districts,as a breakthrough point to discusses such aspects as the present situation of the ownership of parking lots and garages,judicial nature,different forms,ownership theories,legislations in China and so on.The study aims to further improve the relevant laws and regulations in China.
