量刑视野下的“人脑”与“电脑”之争——倡导工具主义立场的“电脑量刑”

Controversy over Human Brain and Computer in Sentencing Perspective

不少民众认为"电脑量刑"就是利用电脑代替法官的人脑进行量刑,这明显是一种典型的误读,不过不少学者仍然看到了电脑量刑背后存在的大量弊端从而对其加以否定,于是在"电脑量刑"的支持者与反对者之间展开了一场激烈的论战。在我国当前的语境下采纳电脑量刑是有客观原因的,因为其对规范法官的自由裁量权和实现量刑的统一以及加速法治的实现有着不可替代的作用。

Many people believe that Computer sentencing is to measure penalty by computer instead of by judge,which is a kind of typical misreading.Meanwhile,a few scholars can not accept it because of its disadvantages,then a hot controversy over it occurs.Under the context of our country,the objective reason determines that we should use Computer sentencing which is vital to supervise the judges＇discretion and realize ruling by law.
