依法治校语境下高校学生权利保障问题探讨

Protection of College Students' Rights under the Running-the-School-by-Law Situation

在高等学校与学生之间的法律关系中,由于学生是教育的对象,是受教育者和被管理者,因此始终处于弱势地位。他们的权利往往被忽略,甚至被侵害,这已成为由来已久的问题。高校学生权利不能得到充分保障主要有立法、观念、执法方面的原因。加强高校学生权利保障的对策是:承担教师教育的院校要把"教育法规课"作为必修课开设;树立民主的师生观;培养学生的权利意识和自我保护意识,提高其维权意识和维权能力;坚持依法治校,依法管理,实现学校管理法制化。

In the legal relationship between institutions of higher learning and their students,the latter always take a weak position because they are the educated and the managed.Therefore,it has been a problem for a long time that their rights are often neglected and even infringed upon.Its causes may lie in legislation,conception,and law enforcement.Solutions to this problem include offering teacher education majors ＂Educational Laws and Regulations＂ as a required course,establishing a democratic teacher-student relationship,enhancing students＇ consciousness of right and self-protection to improve their right-protecting awareness and ability,and sticking to ruling and managing the school by law to legalize its management.
