二重性的困惑:关于虚拟财产的社会学思考

CONFUSION OF DUAL CHARACTER:THOUGHTS ON VIRTUAL PROPERTY FROM THE PERSPECTIVE OF SOCIOLOGY

虚拟财产是网络社会中的重要概念,因其兼具虚拟和现实的二重身份而在法律属性和立法保护上存在较大的争论。虚拟财产的财产属性的确定是对其进行法律保护的前提。运用社会学中的价值理论、冲突理论和符号互动论对所界定的虚拟财产进行分析,明确了虚拟财产具有价值性、排他性和稀缺性的特征,得出了虚拟财产具有财产属性的结论。提出应该从建立基本法规、完善价值确定规则、明确主体与客体的权利和义务以及设立虚拟第三方等几方面入手对虚拟财产进行立法保护。

Virtual property is an important concept of the cyber society.Because of its dual status of both virtuality and reality,there has been a storm of controversy over the legal nature and legislation protection of virtual property.The property nature of virtual property is the premise of its legislation protection.After analyzing virtual property from the perspectives of theory of value,conflict theory and symbolic interactionism in sociology,this paper concludes that virtual property has the nature of property as it has value,and is of exclusiveness and scarcity.Therefore,the authors hold that to protect virtual property we should establish the basic laws,improve the standards of value determination,clearly define the rights and obligations of the subject and object,and set a virtual third-party.
