主客观相统一原则与犯罪构成关系论要

On the Relation Between the Crime Constitution and the Correspondence Between Subjectivity and Objectivity

在行为论中,行为在构造上包括主观和客观两个方面。二者存在内在统一的关系,行为的主观能动地反映客观,客观积极地实现主观。作为犯罪成立之规格的犯罪构成,既不能忽视自身评价对象——行为的构造,又不能抹煞行为构造中各要素之间的联系,因而要将主客观相统一作为重要的方法论,将犯罪构成要素予以体系化,形成犯罪构成体系。主客观相统一原则超越了不同的刑法基本立场的不同内涵,对犯罪构成体系有指导意义。

In the behavior theory,behavior includes the subjective and objective aspects.The subjectivity reflects the objectivity initiatively and the objectivity realizes the subjectivity actively,so they have inherent unification relations.Crime constitution can＇t ignore its evaluation objects——the behavior structure and should pay attention to the relations between the elements.Therefore,the principle of correspondence between subjectivity and objectivity should be seen as an important methodology which will exceed the different connotations of the different basic position.
