摘要
中国的劳动争议处理机制具有特殊的国别特征,也存在一定的不足,主要表现在劳动争议预防体制还存在不足、违背了"仲裁自愿"的传统仲裁立法原则以及"一裁二审"程序造成行政和司法资源的巨大浪费。可以借鉴其他国家或地区的先进经验,在以劳动者为本位的基础上衡平争议双方的权利和利益,取消强制性前置的仲裁环节,赋予当事人"或裁或审"的选择权,在有条件的地区设立专门的劳动法庭,还可试点推行工资保证金制度。
The labor dispute resolution mechanism of China is special in national character, and it has shortages. First, there is lack of preventable labor dispute mechanism; second, the traditional arbitrational legal principle of "voluntary arbitration" is violated; last, the compulsive "arbitration first, then trial" pro- cedure induces the tremendous waste of administrative and judicial resources. We can use for reference to other nations or regions, balance the rights and benefits of the two disputing parties on the basis of " worker standard", cancel the compulsive prepositive arbitration, endow the principals with the right to choice arbitration or trial, set up the special labor lawcourt in possible regions, and make experiments of laborage margin institution.
