自治:宪政建构之基

Autonomy: Foundation of Constitutional Government Construction

自治与宪政的关系是文章阐述的主要论题。文章强调确保人的自由意志的实现是宪政的最高价值目标,自治是人的自由意志的集中体现,因而成为宪政建构的基础;指出当前我国应努力整合社会资源,完善自治基础,制衡国家权力,从制度建构与意识养成两方面着手,建构宪政国家。

The paper elaborates on the relation between autonomous government and constitutional government.It stresses that the realization of personal free will is the supreme target of value of a constitutional government and that autonomy is the concentrated reflection of personal free will.Therefore,autonomy constitutes the foundation of the constitutional government.The author pointes out that China should integrate social resources,improve the autonomous foundation,check and balance the state power and construct a constitutional government,which can be realized from two aspects： system construction and awareness development.
