摘要
"域名权与商标权冲突"是知识产权领域的焦点、热点与难点问题。文章揭示了域名与商标的一些基本法律属性,分析研讨了域名权与商标权冲突的表现形式、冲突的主要原因以及对如何解决冲突进行了法理念分析,以期改善我国此方面立法相对滞后的不利现状,促进我国知识产权法的更加成熟与完善。
＂Conflict between the domain name right and the trademark right＂ is the focal point,the hot spot and the difficult question in intellectual property rights field.The article has promulgated some basic legal attribute on the domain name and the trademark,deliberated the conflict＇s manifestation,and primary cause of the conflict as well as how to carry on the conflict resolution,so as to improves the relatively disadvantageous present situation in legislation in this aspect of our country,promotes intellectual property rights law of our country to be maturer and perfect.
