摘要
随着人类航天活动的日益频繁,空间物体致人损害的事件也不断发生。2009年2月10日发生的美国与俄罗斯卫星相撞事件,再次引起了人们对航天活动致人损害的国际赔偿责任问题的关注。1972年联合国《空间物体造成损害的赔偿责任公约》,简称《责任公约》,是航天国际损害赔偿方面基本的法律依据。《责任公约》规定的国家责任原则以及绝对责任和过错责任的责任基础原则都是颇有特色的。但公约的制定与生效毕竟已经经过了近40年,如今《责任公约》出现了一些不能适应新形势的情形,有必要进行重新思考和加以适当改进。
The basic law ruling the liability caused by outer space activities is the 1972 Liability Con-vention.According to this Convention,the lunching state should be liable for all damages caused by its space objects no matter it belongs to official or private entity.There are two kinds of liability, i.e.,absolute liability and fault liability.Nearly 40 years after its entry into force,the Liability Convention shows some shortcomings which is not suitable for the modern circumstances.In addition Some recommendatory advices for revision are also stated in this article.
