摘要
《中华人民共和国行政诉讼法》第五十条明确禁止调解在行政诉讼中的适用,立法的规定与实践中行政诉讼调解的广泛应用成为我国行政审判中矛盾存在的公开秘密,带来司法实践与理论研究的双重困惑,有必要对此问题进行研究和思考,提出建构我国和谐统一的行政诉讼调解制度的设想。
According to Article 50th of Administrative Procedure Law of The People's Republic of China,mediation system has be excluded from administrative litigation.It is an open secret that legislation repels mediation,which is wild-spread applied in administrative proceeding.All these bring the perplexity of theory and practice.So,it is necessary to study this issue,and give some advice on constructing a harmonious and unified ad-ministrative litigation mediation system.
