高校学生处分说明理由制度就是高校在对学生拟作出或者作出处分时,高校必须向学生说明作出该处分的事实根据、法律依据和自由裁量的主要因素等的制度。在程序正义的呼声日益高涨的今天,高校处分程序的正当性也受到社会的关注。本文从高校学生处分说明理由制度的界定出发,从法理基础、内容与形式、行为效力以及制度完善等五方面加以分析,以期对高校处分正当程序有所启示。

Disciplinary Justification system for college student punishment demands that universities,when in imposing sanctions,must deliver explanations to students to make the punishment based on facts,legal basis and discretionary system of the main factors.In present society of growing process justice,the legitimacy of university disciplinary procedures has also been the concern of the society and community.This article presents an analysis from the following five aspects： legal basis,content and form,behavior effectiveness and the system improvement in order to legitimate the existing procedures of disciplinary measures.
