The Reasonable Patterns of Service Abroad of Documents——To Explain in Concern Foreign Civil Case Resume

涉外送达耗时长、成功率低的问题一直以来都困扰着各国的涉外民商事诉讼,在诉讼中选择哪种送达方式以及时、成功完成送达,就显得尤为重要。对其从理论与实务层面进行分析,引进了送达方式的层级体制与双轨体制的概念,重新定位其应用范围;对英美法系国家存在"在场送达"进行介绍,希望可以吸收到我国法律体系中;对公告送达重新定位,使其从补充地位提高到附加地位。

There are some problems in concern foreign civil case resume such as slowing and lower rate of success. It is more important to select the reasonable patterns, which will be done on time and successfully. The article analyses them in theory and practice and introduces two concepts of control of service through different ranks and two-track system. In order to assimilate to our legal sys- tem, it also introduces the personal service in countries of Anglo-American Law System. At last, it reorients the concept of service of announcement.
