中外围填海管理的比较研究

Comparative Studies: Coastal Reclamation Management between China and Abroad

将我国的围填海发展历史及管理现状分别与日本、荷兰、韩国进行对比分析,发现缺少具体的法律规范、分行业的海洋管理体制和重审批、轻规划的管理方式是我国围填海管理滞后的主要原因。建议制定专门的围填海相关法律,建立有效的海洋咨询、协调机构或组织,加强围填海总体规划和具体项目的设计指导,以实现我国海洋环境和资源的保护及合理有效地利用。

This paper compares the development reclamation history and managerial situation in China to Japan,Netherlands and Korea.It finds that the primary causes for the lag in reclamation management are the penury of specific law or norms,the dispersive administrative functions among several sector authorities and the management mode which highlights examinations and approvals and belittles the plans.The paper suggests that the policies and regulations according to local conditions should be formulated;effective advisories and coordinated institutions or organizations should be built;the guiding works for general plans and specific items of reclamation should be strengthened.Then the marine environment and resources could be protected and rational used.
