基于地役权权利金的土地补偿模式设计——电网建设外部环境中的冲突及互适应机制研究之四

Design of the Land Compensation Mechanism Based on Grand Easement——The Fifth Research Paper Study on the Confliction and Self-adaptive Mechanism in Constructing the Power Grid

2007年10月1日起施行的《物权法》进一步明确了地役权补偿的概念。但针对我国对于电网建设这种基于公益性建设的线状工程用地的权利和补偿并没有给出如何确定补偿金额及补偿方式,这个问题在电网建设用地过程中尤其突出。本文在对国外电网建设地役权的补偿金额及补偿方式的确定模式的研究基础上,对如何《物权法》中的地役权制度与电网建设用地补偿制度相结合进行了探索性的研究,设计了基于地役权权利金的电网建设用地土地补偿模式,该研究有利于完善我国的《物权法》及《电力法》中的地役权补偿制度。

The ＂property law＂ effected for Oct.1,2007 further clarified the concept of compensation for the easement.But for power grid construction in China for the construction of such a linear-based nonprofit project of land rights and compensation and did not give a how to determine the amount of compensation and compensation methods,the problem is the process of grid construction sites in particular.In this paper,the foreign power grid construction easement in the amount of compensation and compensation methods based on the study to determine patterns of how to ＂Property Law＂ in the easement system and power grid construction land compensation system for combining the exploratory research,design easement rights based on payment of land compensation for land for construction of power grid model,the study helps to improve our ＂Property Law＂ and ＂Electricity Law＂ in the easement compensation system.
