刑法分则中5个条文的6个罪名中规定有"本法另有规定的,依照规定";通说认为,该规定确定了"特别法优于普通法"的法条竞合适用原则。其实,该规定属于注意规定,无论是否存在该规定,均应按照想象竞合犯"从一重处罚"原则处理,不应将暴力干涉婚姻自由、妨害公务的手段行为限于轻伤,无论轻伤还是重伤、杀人,均构成暴力干涉婚姻自由罪、妨害公务罪与故意伤害罪、故意杀人罪之间的想象竞合犯;国家工作人员利用职务上便利骗取3000元财物的,不构成贪污罪,但可以诈骗罪论处;国家机关工作人员徇私舞弊招收公务员,情节特别严重的,可以滥用职权罪论处。
