公共利益不是与个人利益、集体利益或者国家利益相同性质的范畴。公共利益是一种社会秩序,是一种促进社会全部主体参与利益分享的秩序。它为所有社会主体所需要,而又不被任何社会主体所独占。在过去的社会,公共利益表现的是利益分配的等级秩序。在现代社会,公共利益是一种社会主体平等参与利益分享的社会秩序。今天的法律并不是保护某种特定主体的特定权利的工具,让社会全部主体的利益需要得到实现才是现代法律的精神。因而,公共利益是促进社会全部主体享有各自利益的秩序,使社会全部主体共生共荣才是公共利益的本质属性。

The public interest,not with individual interests,collective interests or national interests of the scope of the same nature.The public interest is a kind of social order,is a kind of all subjects involved in the promotion of social benefit-sharing order.It is necessary for all social subjects,but not exclusively by any social body.In the past the community,public interest is the performance of the hierarchical order of distribution of benefits.In modern society,the public benefit is a social benefit-sharing and equal participation of the main social order.Today＇s laws do not protect the rights of a particular subject-specific tools,all of the main interests of the community need to be achieved is the modern spirit of the law.Thus,the public interest promote to all of the main body of society to enjoy their own interests in order so that all of the main body symbiotic society is the essential attribute of the public interest.
