摘要
最高人民法院《关于审理建筑物区分所有权纠纷案件具体应用法律若干问题的解释(征求意见稿)》中肯定了部分非所有权人的"业主"地位,扩大了业主的范围。但此举与现行通说相悖,将引发诸多的法律冲突。要明确尚未取得所有权的买受人、受赠人等实际占有使用人就区分所有建筑物的权利义务,并不一定非要赋予其"业主"地位,可以通过合同法原理、专有部分占有人的新设或《物权法》占有规定的准用等予以解决。
The judicial interpretation about partitioned ownership of building areas(public comment edition) took those who are without partitioned ownership of building areas as owners.There was conflict with the dominant ideology.It would result in the conflict between the rules.There are some other settlements to this problem.It includes the contract way,the analogy of the rules about possession,etc.
