摘要
商务部公开的"异议案例"信息表明,在法律规范不明确、执法能力和资源有限等制约因素下,中国的企业合并反垄断审查实践呈现出渐进式的发展脉络,而且执法效率也维持在可接受的范围之内。但在反竞争影响的分析判断、限制性条件的设置和实施方面,商务部的审查决定存在显著缺陷。
The information regarding challenged cases released by MOFCOM shows that China＇s anti-monopoly review against concentration has turned out to be a step-by-step progress even under the restraints from the uncertainty of law and the lack of enforcement ability and resources. Besides, MOFCOM＇s efficiency is also acceptable. However, the authority＇s decisions have an obvious defect with regard to the analysis, judgment, and relief of anti-competition effect.
