产权理论视角下家庭联产承包制度的反思——兼论我国农地使用制度的完善

The Reflection of Family-hold Contract System under the Perspective of Property Right——On the Perfection of China's Agriculture Land Use System

产权作为一个经济学范畴对人类法律制度的变迁具有积极的意义。家庭承包经营作为我国在特定历史背景下的产权制度设计,在目前的农村经济生活中表现出了相对的滞后性:它不具有完全的排它性、完全性、可转让性,表现出非效益性;其制度约束、激励功能下降并产生了较大的诸多负外部性,产权功能缺失。基于此认识,可以考虑从产权的路径出发,克服我国农地使用制度的缺陷。

As a economic category,property right is meaningful to the change of human legal system.Family-hold contract system as an institution design of property right in the special history circumstance,shows serious delay in current country economic life,which is not exclusive,complete and deliverable,as well as unbeneficial,which is institutional restraint and encouragement function falls down and arises externalities.Base on such views,the author gives some advises on how to overcome the shortcomings in Chinese farmland institution by the way of property right.
