传闻证据规则在我国的移植与障碍分析

An Analysis of the Transplanting and Obstacle of Rumour Evidence Rules in China

传闻证据规则是英美法系国家一项重要的证据规则,原则上要求排除传闻证据。我国尚未确立传闻证据规则。就功能而言,确立传闻证据规则有利于解决证人不出庭作证,遏制非法取证,保障当事人的诉讼权利。我国刑事诉讼存在过分追求事实真相理念和审判缺乏对抗性等问题,这些观念和制度阻碍着传闻证据规则的确立。在借鉴国外法治经验和结合中国国情的基础上,从三个方面构建我国传闻证据规则,以期完善证据制度。

Rumour evidence rule is an important evidence rules in Britain and U.S.A.It should be excluded in principle.In China this rule has not been established.As for function,it is beneficial to witness＇ default.Some problems in China prevent the establishment of this rule.Drawing lessons from other countries and taking account of China＇s situation,this rule can be established from three aspects so as to perfect evidence system.
