本文主要通过对"仰融案"、"莫里斯案"、"加拿大天宇网络有限公司案"几个以中国政府为被告的典型案例的分析比较,对美国法院适用《外国主权豁免法》中商业活动例外的规定加以研究。文章分析《外国主权豁免法》中关于商业活动例外的规定即第1605节(a)(2)款的具体组成及其对适用产生的影响,同时为中国政府以后的诉讼提供建议和帮助。

This paper,through a comparative analysis of several typical cases of ＂Yangrong Case＂,＂Morris Case＂ and ＂Sky Network Canada Ltd.Case＂ that took the Chinese government as the defendant,studies how the courts of the United States applied commercial exceptions in accordance with the ＂Foreign Sovereign Immunities Act＂.Also it analyzes the relevant provisions on the commercial exceptions as stated in Item 2,Clause A,Section 1605 of the ＂Foreign Sovereign Immunities Act＂,its specific composition and its impact on the application,while provides the Chinese government with advice and assistance in the future actions.
