《唐律疏议》“德主刑辅”立法思想和儒家人性论关系探析 被引量:1

摘要 《唐律疏议》由十二篇构成,《名例律》居诸篇之首,共六卷,五十七则律文,其内容涵盖了唐律的立法理论和基本司法原则。儒家思想极其深刻地影响了《名例律》关于立法的思想,人性学说是儒家哲学体系架构的逻辑前提,于是唐律立法理论宏观上以儒家人性思想为基本前提,并且在"德主刑辅"的立法思想中贯彻了儒家的人性思想,儒家坚持人性经教化可以从善弃恶的观点,所以,唐律立法理论关于德礼与刑罚的价值取向是德礼为主,刑罚为辅。 Law of the Tang Dynasty and Its Interpretation has 12 chapters. Ming Li Lv is the first chapter, includ-ing six volumes, 57 articles, which covers the legislative theory and basic judicial principles of Tang laws. Confucianism produced extremely profound impact on the ideas on legislation in Ming Li Lv. Human nature theory was the premise of Confucian philosophy system, so human nature of Confucianism was the macro-premise of the legislative theory of Tang laws. Furthermore, the idea "virtue first, punishment second" implemented human nature of Confucianism. Confucianism insists on that the humanity can abandon the evil to the goodness through education. Therefore, the moral value of the legislative theory of Tang laws was "virtue first, punishment second".
