法律移植的过程是外来法律植入本土的过程,本土的法律会影响法律移植的深度与广度。寻求外来法与本国法的最佳结合是任何国家都必须面对的问题,法律移植必须考虑本土的因素,否则移植将会失败。

Legal transplantation is process of transplanting foreign laws,the degree of which is more or less determined by the indigenous laws. To seek the best coordination between foreign laws and indigenous laws is a fundamental task for any country. To avoid failures,indigenous factors should by all means be taken account of in legal transplantation.
