民办高校法人属性研究——基于“民办非企业单位”法人登记的分析

Research on the Legal Nature of Private Colleges:Based on the Analysis of Legal Registration of Private Non-enterprise Entities

民办高校只能按照民办非企业单位类别进行法人登记,并无基本法层面的依据。以是否"利用国有资产"举办,区分并定性一所高校,折射出现行法律中以"所有制"划分类别并施以不同管理的传统思路。因而,"清理并纠正对民办学校的各类歧视政策,"①应该从这一根本问题着手,要通过立法重新解释"事业法人",将非营利性民办高校纳入其中,并推动民办高校"营利性与非营利性"的"分类管理",这也是"依法管理民办教育"的有效路径。

Private colleges registered as private non-enterprise entities have no legal foundation but result from the governmental discrimination. To classify colleges by ownership is the logical starting point of inequality in laws, policies and the reality. To correct the discriminatory policies against private schools needs to reinterpret the concept of ＂Institution Corporation＂ and bring the non-profit private schools in. To advance the division of profit and non-profit private colleges by legislation is the effective way to promote the corporate governance.
