现行食品卫生行政许可制度存在的问题及其改革对策

Issues and Countermeasures In Current System of Food Hygiene Administration License

随着市场经济及行政法制理论的发展，现行的食品卫生许可制度暴露出一些与其不相适应的问题，如：发证与监督相脱节；初审的概念不明，权限不清；许可的条件和标准不完善；许可的程序不明，监督制约措施不力等。其中，以程序问题尤为突出。在针对存在问题进行分析的同时，还根据有关行政法原则及行政许可理论对其提出了改革对策，期望不断提高食品卫生许可水平。

With the development of market economy and administrative legal theory, some issues appear in current system of food hygiene administration license. The major issues are disjoint between license release and supervision, unclear in first trial and popedom, imperfect of licenses condition, standard and process, and slack in supervision restrict measurement. While analyzing these issues, the author proposes reform countermeasures and expects upgrading the level of food health administration license.
