摘要
本文通过对果洛藏区构建和谐社会过程中出现的习惯法与国家法的冲突现象的审视,提出了要以人本为理念,先占为原则,逐步调适冲突的思路。
This paper examines the conflict phenomenon between the tribal habit law and the law of the state,and presents the concept of people-oriented,the doctrine of uti possidetis,and the thought of conflict adjustment.
