在适用行政法基本原则的司法审查实践中,怎样才能做到既有效克服成文法的疏漏、僵硬及冲突,又不至于造成法律适用混乱和法官滥权?其关键就在于找到行政法基本原则适用的时机。只有在"穷尽规则"和"充足论证"的前提条件下,行政法基本原则才有适用的可能性。具体而言,只有在行政法规则缺失、行政法规则涵盖过宽、行政法规则模糊、适用行政法规则的结果导致明显的不公正或行政法律规则相互冲突的情况出现时,原则才允许被适用。
