摘要
一般认为,两种基本权利体系,即自然法理论为基础的基本权利体系和社会学理论为基础的基本权利体系。但是基于"自由权—社会权"二分法在现代社会面临的困境,本文试图以功能为中心对基本权利体系进行"三分法"的重新构建,即防御权、受益权和保护权。
First of all,the article introduces two basic rights system：basic rights system founded on natural law theory and basic rights system founded on sociology law theory;secondly,it analyzes ＂freedom rights-society rights＂ dichotomy facing delimma;finally,it trys to design again for basic rights system focusing on function,namely,trichotomy：defensive rights,beneficial rights and protective rights.
