对工伤死亡赔偿问题的探讨

工伤保险是五大社会保险之一,每个用人单位都必须为职工办理此项保险,是对职工的一种保障。工伤保险包含的内容很多,工伤死亡赔偿是工伤保险赔付最多的一项。中国工伤赔偿50余年来所走的历程是由国家赔偿到企业赔偿再走向国家赔偿和社会赔偿,是国家经济体制由计划经济转向市场经济及由此带来的经济结构变化等的客观结果。企业和属地管理单位,都要义务购买职工工伤保险,它是一种文明措施。对工伤死亡赔偿与民事损害赔偿之间的种种相互关系进行了探讨,并对现行工伤死亡赔偿问题提出了一些建议。

Industrial insurance is one of the five social insurances and every unit should pay the insuranco for the employces, which is also one kind of insurance to the employees. Industrial insuranco includes many kinds and death compensation is one which pays the most. Industrial insurance in China has gone this road in more than 50 years from national compensation, to enterprise compensation and now to national compensation and social compensation and it results from the change of economaic structure, from planed economy to market economy. The en- terprise and the management unit belonged two should buy industrial insuranco for the employees, which is one kind of cultural measures. This paper discusses the correlation between the industrial compensation and civil compensation and gives some suggestions on the present industrial injury death compensation.
